Intellectual Property Policy

At CC, we are committed to protecting intellectual property rights for artists, designers, and makers. We adhere to intellectual property laws and industry standards to uphold the integrity of our creative marketplace. This Intellectual Property Policy outlines our approach to handling infringement allegations, the process for authorized parties to report infringements, and how CC support can assist when listings or shops are impacted by such reports.

This policy was published on 30 July 2024, and will take effect on 31 July 2024.

1. CC's Role

 

CC is a marketplace where individual create templates. CC provides a platform but does not manufacture goods, hold inventory, or deliver items on behalf of sellers. Content on CC’s marketplace is generated by part time staff who are not employees, agents, or representatives of CC. Staff members are responsible for ensuring they have all necessary rights to their content and are not infringing on any third party’s rights.

CC reserves the right to disable any listing, shop, or account that violates our Terms of Use, including this Intellectual Property Policy or our Prohibited Items Policy. CC also reserves the right to take action against those who abuse our Intellectual Property Policy or Terms of Use.

CC cannot speak on behalf of intellectual property owners, provide legal advice, or determine whether a shop’s content infringes on someone else’s intellectual property. CC will remove material cited for alleged intellectual property infringement when provided with a report that complies with our policies.

 

2. Reports of Intellectual Property Infringement

 

CC strives to respond quickly to reports of intellectual property infringement that comply with our policies by removing or disabling access to the allegedly infringing material. When material is removed or access is disabled, CC makes a reasonable attempt to contact the affected member, provide information about the report and removal, and, in cases of alleged copyright infringement, provide information on how to submit a counter notice. CC may also provide a copy of the infringement report, including the name and email address of the reporting party, to the affected member.

To report alleged infringement on CC shop listings, you can email to report-ip@clevercertificates.com. This is the easiest way to report alleged infringement to CC and its Designated Agent under the Digital Millennium Copyright Act and other intellectual property rights.

To report alleged infringement on usernames, shop names, or videos on a CC shop page or from an Explore post on CC, use CC’s Contact Us Form.

If you are unable to use the CC Reporting or Contact Us Form, you can email support@clevercertificates.com.

CC may request additional information before processing a report, such as a letter of authorization from the rights owner, identity verification of the reporting party, or other documentation regarding the claimed right. CC may reject reports of infringement or counter notices that contain information believed to be false, fraudulent, incomplete, or submitted in bad faith. CC also reserves the right to take action against abusers of this policy.

 

3. Counter Notice

 

In accordance with the Digital Millennium Copyright Act (DMCA), CC accepts counter notices for US-based copyright infringement reports only. When CC receives a DMCA counter notice, we will provide a copy to the original complaining party. The removed material may be replaced or access restored 10 business days after processing the counter notice, unless the copyright owner seeks a court order restraining the allegedly infringing party from relisting the items or files a qualifying action with the Copyright Claims Board (CCB), and informs CC of this action. 

 

4. Repeat Infringement

 

CC terminates the selling privileges of members subject to repeat or multiple notices of intellectual property infringement in appropriate circumstances and at CC’s discretion. If we believe a member has attempted to create a new template after termination of the initial account, we reserve the right to refuse all services to that member. These actions apply to any accounts believed to be associated with or operated by the affected member. Per our Terms of Use, CC reserves the right to terminate account privileges at any time, for any reason, and without advance notice.

 

5. Withdrawals

 

CC only accepts withdrawals of infringement reports directly from the intellectual property owner or authorized representative who submitted the claim. The withdrawal must clearly state it is a formal withdrawal and sufficiently identify the member and/or material (such as by providing the CC listing URLs).

Once CC receives a formal withdrawal of an infringement report, CC will contact the withdrawing party to confirm receipt and notify the affected member of the withdrawal. Please note that infringement matters are reviewed on a case-by-case basis, and withdrawals do not guarantee changes to a member's shop status.
